Part 2
On calculation of case volume.

This needs to be done for each jurisdiction used in the calculations.
Some are easy, the US DOJ compiles a complete list of all cases by type
in the US.

Australia has similar reports but these are not as accurate in time
taken etc. For each court (and I will just do the single one here) the
last case is the highest number allocated. In the Australian instance
cases are issued by court as follows
        NSWSC           xxxx of 200x
        High Court      Xxxx/200x etc

Thus if the last case in the NSWSC (NSW Supreme Court) for 2005 (and
prior years) are available from
http://www.lawlink.nsw.gov.au/lawlink/caselaw/ll_caselaw.nsf/pages/cl_sc

The High Court of Australia is available from:
        http://www.highcourt.gov.au/registry_05.html (and for other
years)

One may also cheat slightly (as I did) and read the compiled court
registry reports. These may be obtained through CCH (this requires a
subscription and are copywrited). CCH Law is accessed from
http://www.cch.com.au/fe_topic_home.asp?display_tab=7.

Obtaining journals and conducting journal searches is also easy. I use
EmeraldJournals for the most part, but being associated with a couple
Universities also helps and allows online library catalogue searches.

As a further plug, IEEE has a good database of information for members.

Back to sourcing data... Butterworths and ICLR also have and can supply
the same data as used (and in this case obtained using CCH).

I guess also though the easy way to have shown this would to look at the
USDOJ as it currently stands being "swamped" with cases and having to be
selective. Over the last ten years the USDOJ has 110 cases (last years
figures) involving computers in crime (and these are mostly child porn).


The simple answer is with 164 (as of 2004) cases worldwide, there is not
the resources to take all cases to trial even if this was desired. This
is the point I have been making.
