Note that major ISPs are all over the map on acceptable use policy regarding "doorknob twisting" (e.g. port scanning).  
In our recent experience, for example, AOL will not take action against a port scanner on their network unless laws are 
being broken.  This in spite of their AUP prohibiting posting or distribution of content "designed or intended 
to...obtain unauthorized access to any data".  Apparently it's ok to use it as long as you
don't post it....
