Because the MPAA's wishes are a legal requirement, whereas the author of that code was phrasing a request.
As I said - the moral high road, not the legally mandated one. Given that the MPAA's opponents will, to a great degree, justify *their* actions with "the MPAA is just out to rip everybody off as much as they can", not following the guy's wishes merely because they have no legal obligation to is just giving ammunition to the enemy.
