Professor Farber: As a Californian, I feel it is only fair to correct a
misstatement in the article and point out that California is by no means
the first state to give electronic signatures legal validity. Eight states
have previously done so for all electronic signatures, and many more states
have done so for electronic signatures with specified authentication
attributes. The best source for a complete list is the McBride Baker &
Coles law firm's Web site at http://www.mbc.com/ecommerce/.

California is the first state to adopt the Uniform Electronic Transactions
Act, which it is hoped will reasonably soon be adopted by all or almost all
of the states and therefore create a level of uniformity desirable for
online commerce. For those who want to pursue this further, the text of
the California statute is at
http://www.leginfo.ca.gov/pub/bill/sen/sb_0801-0850/sb_820_bill_19990916_cha
ptered.html.
