Dear Geoff,

The very deal upon which both the CARP and the Librarian of Congress
have used as a base for rates for the Internet radio industry -- the
Yahoo!/RIAA agreement -- was SPECIFICALLY crafted to make it difficult
for smaller webcasters to compete against Yahoo!

That's according to Mark Cuban, whose Broadcast.com company was acquired
by Yahoo! shortly before the webcasting agreement was signed. He tells
RAIN in an e-mail that Yahoo! conceded an artificially high royalty rate
to avoid a "percentage of revenue" arrangement -- so that
less-well-funded webcasters would be unable to compete!
