    With regards to patents on menu structures for music and videos,
there are a variety of earlier patents.  Yes as Apple's patent  
application
may be susceptible to anticipation by Microsoft's patent application, so
to may Microsoft's patent be susceptible to anticipation both by even
earlier patents and journal articles.
    The people writing about this threat to Apple are generally  
clueless
about the realities of the patent system.
