Let's look to some existing experience for a guide. The EU has Data Protection laws, and has had for some time. How are they handling mailing lists?
I spoke with Senate Judiciary committee staff on Friday and they said they weren't trying to mirror the Data Protection Directive, so I'm not sure this question is relevant.
But if a future hypothetical bill were to mirror the Directive, we can look at the research of Jacob Palme, a professor of computer science at Stockholm University (http://www.dsv.su.se/jpalme/). Jacob has documented some of it has been used (abused) against churchgoer websites, dog owner websites, search engines, anti-bank activists, and animal rights activists:
