DaveI think your analogy is faulty. Brett is using a COMMON free frequency along with anyone sle who wants to try. The case being considered is, as far as I know, an exclusive use of that "free" spectrum . Worse yet I bet that if they go bankrupt, as some would predict, the court considers the gift of frequency as property to be disposed of in bankruptcy -- to one of the big guys most likely.

Let me get this straight:A company (Brett's Lariat.com) that has prospered using *free* part 15 spectrum to compete against other paid broadband providers is wailing that *free* spectrum granted to other competitors is unfair?
Isn't sauce for the goose appropriate for the gander?I don't think we need to delve deep into technical or economic analytics to understand this logic. Failing businessmen often ask the government to bail them out or protect them from competition.
