Sure, it'd not be at all impossible to re-implement the functionality of
nmap. For that matter, a lot (most?) of the functionality of nmap
already exists in other tools (strobe, hping, udp_scanner, libsf, etc). 
In my opinion, nmap's true value comes from the integration of various
techniques distributed among a lot of other tools into one consistent
interface.  That being said, the OS fingerprint database is the result
of a LOT of contributions submitted over the course of years. 
Reimplementing that would take quite a bit of time, work, and access to
more resources than any one person probably has (legitimate) access to. 
But the hard part there is recreating the 'data' not the 'code'.
