On Monday, the world's fattest antitrust target will file papers telling the DC Circuit Court of Appeals exactly what it thinks of the U.S. government's attempts to smash it into pieces. (The short answer: Not much.) In an unusual October 11 order, the appeals court gave both sides a hefty 150 pages to make arguments in their respective briefs. They government's response is due January 12, 2001, with oral arguments in court likely to be held in the spring. The loser is all but certain to appeal its loss directly to the U.S. Supreme Court. The appeals judges aren't taking any chances with lawyers from either side trying to squeeze in more paragraphs by diddling with font sizes: "All briefs must be filed using proportionally-spaced type of at least 12-point, with margins of at least one inch on all sides." Or maybe the judges just don't want to use their glasses.
