I've been away for a few days, and have not read this entire thread, but my $0.02:

Interestingly enough, law enforcement can use 'publicly displayed' in regard to the fourth amendment (search and 
seizure).  Some examples:

And yet, you can go to the beach, on a hot summer day, with your video camera and film all the people on the beach that 
you want.... With only the fear of a BIG boyfriend beating the snot outta you for filming his girlfriend sun-bathing :-)

  the way I look at it, if it's in public, it's fair game for ANY picturetaking or filming.  If something shouldn't be 
filmed or snapshotted, then it shouldn't be in plain public view....
