I don't get the difference - I'm sure they're allowed bathroom breaks.
Knowing that they're in the bathroom isn't a violation of privacy -
unless the phones have cameras which can be remotely turned on! ;)
And, as you point out in your follow-on message, they're union
workers, no wonder the public would like some accountability.

Fire them. Break the union. Move on.
