It's when you start using it to measure how much time the guy spends in his office versus when he's down the hall in the bathroom that it becomes an issue....
I don't get the difference - I'm sure they're allowed bathroom breaks. Knowing that they're in the bathroom isn't a violation of privacy - unless the phones have cameras which can be remotely turned on! ;) And, as you point out in your follow-on message, they're union workers, no wonder the public would like some accountability.
