IANAL, but I would tend to think that the natural and obvious defense for these kinds of IP lawsuits, would be a countersuit for the reverse engineering of a licensed product to begin with? If, for example, someone provided a brilliant OS patch for MS Vista and then tried to sue them for rolling out anything similar...
