I'm willing to bet that anyone raising questions about data retention
will be told that the database can be used to help catch terrorists. 

I don't know about real life, but on Law&Order they've caught ordinary
criminals many times by looking through EZPass records. Amd even at this
late date Tony Soprano uses a regular New Jersey Turnpike ticket rather
than EZPass on the opening credits, so I assume he figures it can be
used to track him. (In an early episode Tony's on his kid's computer and
says how "this cookie shit scares the hell out of me.")
