IANAL, etc., etc., but I believe a form of ex post facto is amnesty.

How is this not a text book example of an ex post factor Law?

Actually, it's the exact opposite of an ex-post facto law, which makes
an act illegal after the fact. This law makes something legal, or at
least removes civil liability, after the fact.
