Spector Pro is what we use.  I'm a Sr. Network Analyst for a 450 user Law Firm in Southern California and I've been 
working in Law Firms for about 10 years.  This is something we've used in the past at client sites to capture data.  
The only thing wrong with it is if the user knows their being monitored, Spy Cop, etc may be able to find the software 
loaded in memory.  Otherwise, the software is amazing.  It captures key strokes, and screenshots.  VERY GOOD especially 
for the price.

I am looking for a tool that I can load on a Windows
98 System that once the user logs on the tool will
capture everything the user does and allows for
playback.  This tools output may need to hold up in
court.

If there are any costs involved please let me know.

The computer has a legal notice and my client believes
