You could apply for a patent for it and so long as the patent examiner did not find your publication, a patent could be granted, but if someone else then challenged that patent on the grounds that you, the applicant, had previsouly published the idea, I strongly suspect that the patent would be revoked much more easily than if someone else had filed the application and _you_ challenged their patent. Yes, it's seriously borked...
