The telcos are GIVING this data up. No need for executive powers. No
need for courts .No need for subpoenas.

Police do use phone records but they do have to get subpoenas for
phone records because, from what I've been able to ascertain of the
various sky-is-falling news articles, the records the cops would be
after are by customer - not just piles of data as is what the NSA
wants.
